The HIPAA Privacy Rule is the fundamental HIPAA Rule because it regulates permitted uses and disclosures of protected health information (PHI), explains an individual’s rights regarding their own PHI, and mandates that covered entities have administrative, technical, and physical safeguards in place to protect the privacy of PHI. The Privacy Rule has been in effect since 2003. The Security Rule was followed in 2005 to protect against uses or disclosures of electronically maintained or transmitted PHI in violation of the Privacy Rule. In 2009 the Breach Notification Rule established procedures that must be followed when PHI is accessed, acquired, used, or disclosed in a manner not permitted by the Privacy Rule. Although it is the oldest and most important HIPAA Rule, Privacy Rule compliance has been uneven, partly due to its length, confusing structure, and the legalistic language in which it is written. The Security and Breach Notification Rules are shorter and structured. However, as this seminar is designed to show, the Privacy Rule can be taken apart and organized in steps that are easy to follow.
