In 2007, Medicare and Medicaid implemented their third and final phase of the Stark Law.This law prohibits physicians from referring patients to any entity in which they have a financial interest.Violating the Stark Law results in nonpayment for the services requested, a physician being forced to pay back monies collected, financial fines and penalties, and more.Since its implementation, compliance issues have been forefront in discussions involving health care.More recently, however, there have been substantial awards and settlements involved in violating the Stark Law.This is no longer just a compliance issue, is has become a risk management issue.

In the face of theses recent settlements and awards for violating the Stark Law, it is imperative that physicians understand the full scope of the law itself.  In order to ensure compliance, physicians must balance compliance and risk management by ensuring they have contracts that are legally defensible under applicable laws.
